Chapter Two - Victory Today is June 16, 2008, 20 months and 11 hearings after I filed a complaint against the Devonshire East Homeowners Association. I am writing to report that the CCOC Panel ruled in my favor and against the DEHOA Board in their Decision issued May 21, 2008. In a rare move, they awarded me attorney's fees. We have estimated that my costs are approximately one-fifth or less than those charged by the attorneys hired by the the Board and their lawyers are trying to make a case for appeal on not only the award of attorney's fees but on the findings of fact that led to 10 "orders" they are objecting to. The attorneys for the Board who are being paid by the Insurance Company (whose premiums are paid in part by me) are active members of the CAI and claim to represent the interests of homeowners in our community; many of us feel it is only three members of the delinguent Board (and their lawyers) whose interests are represented. The Board's lawyers have been paid over $100,000 to lose a case they now want to appeal. Three Board members responsible for my issuing the complaint have managed to avoid an election for two years and remain in control of the community although by order of the panel, they will have to hold an election in September. The conduct of lawyers for the Board who are active members of CAI, have at every opportunity, backed the egregious conduct of this Board, surprised that an individual homeowner would pay out of pocket to acheive good governance. If the CAI wants to prove they are for the "little guy" as well as having their hands in the pockets of the Insurance Companies, let them show us how they are lobbying in state legislatures for improved governance in HOA's across the nation.
