RE: "Because that is what associations are - businesses." Most business do not have government laws requiring folks sign a contract with them. (In Colorado all new homes, in neighborhoods of 10 or more, fall under the CCIOA). Realistically, you cannot buy a new home in Colorado without signing into a HOA. That is NOT FREEDOM of choice, or freedom of contract. Having to agree to a Goevernment Mandate Contract to move into a neighborhood seems unconstitutional to me. Re: They aren’t governments, they aren’t personal private clubs, and they certainly aren’t fascist states created to deprive poor, unsuspecting homeowners of their rights. They are businesses that need to be run in a professional and business-like manner. If they are not governments, then why can they regulate parking when they do not pay for street maintenance, do not pay for plowing, etc, ?
